These Terms and Conditions ("Terms") govern your use of our website and travel services. By booking with us or using our website, you agree to these terms. Please read them carefully.
1. General Information
1.1 About Us
GoWhere Travel and Tours ("we," "us," "our") is a travel agency located at Mabalacat Pampanga. We specialize in creating custom travel experiences and group tours.
1.2 Agreement
By making a booking, inquiry, or using our website, you ("you," "your," "traveler") agree to these Terms and Conditions, which form a binding contract between you and our agency.
2. Booking and Payment Terms
2.1 Booking Process
- All bookings must be made through our website, by phone, or email
- A booking is confirmed only when we send written confirmation
- Prices are subject to change until booking is confirmed
- All travelers must provide accurate information during booking
2.2 Payment Schedule
- Deposit: 25% of total trip cost due at booking
- Final Payment: Balance due 60 days before departure
- Late Bookings: Full payment required for bookings made less than 60 days before departure
- Payment Methods: Credit card, bank transfer, or certified check
2.3 Pricing
- All prices are per person in Php unless otherwise stated
- Prices include services specifically mentioned in your itinerary
- Prices do not include: airfare (unless specified), travel insurance, meals not mentioned, personal expenses, tips, visa fees, or optional activities
- We reserve the right to adjust prices due to currency fluctuations, fuel surcharges, or increased supplier costs
3. Cancellation Policy
3.1 Cancellation by Traveler
Cancellation fees apply as follows:
- 90+ days before departure: Php 5,000 per person administrative fee
- 60-89 days before departure: 25% of total trip cost
- 30-59 days before departure: 50% of total trip cost
- 15-29 days before departure: 75% of total trip cost
- 14 days or less before departure: 100% of total trip cost (no refund)
3.2 Cancellation by Us
We may cancel your trip due to:
- Insufficient enrollment (minimum group sizes)
- Force majeure events (see Section 8)
- Safety or security concerns
- Supplier cancellation
If we cancel:
- Full refund of all payments made
- No compensation for additional expenses (flights, visas, etc.)
- We will assist in rebooking when possible
3.3 Travel Insurance
We strongly recommend comprehensive travel insurance. Cancellation fees apply regardless of reason unless covered by insurance.
4. Changes and Modifications
4.1 Changes by Traveler
- 60+ days before departure: Php 10,000 fee per change + any supplier fees
- Less than 60 days: Subject to availability and full cancellation terms may apply
- Name changes: Php 10,000 fee + supplier charges
- Upgrade requests: Subject to availability and additional cost
4.2 Changes by Us
We reserve the right to modify itineraries due to:
- Weather conditions or natural disasters
- Political situations or safety concerns
- Supplier changes or closures
- Local conditions beyond our control
We will provide comparable alternatives when possible and notify you immediately of any changes.
5. Travel Documents and Requirements
5.1 Your Responsibility
You are responsible for:
- Valid passport (6+ months remaining validity)
- Required visas and permits
- Health certificates and vaccinations
- Travel insurance documentation
- Arriving at designated meeting points on time
5.2 Documentation Assistance
We provide general guidance on travel requirements but you must verify all requirements with appropriate authorities. Requirements can change without notice.
5.3 Failure to Meet Requirements
No refund will be given for inability to travel due to inadequate documentation.
6. Health and Safety
6.1 Health Requirements
- You must be in adequate health for your chosen trip
- Inform us of any medical conditions, dietary restrictions, or mobility limitations
- Some activities may have age or fitness requirements
- Pregnancy: Consult your doctor and inform us before booking
6.2 Travel Advisories
- Check government travel advisories for your destination
- We monitor safety conditions but cannot guarantee safety
- You travel at your own risk regarding health and safety
6.3 COVID-19 and Health Protocols
- Comply with all local health requirements and protocols
- Health requirements may change and affect your trip
- Additional costs for testing or quarantine are your responsibility
7. Liability and Limitations
7.1 Our Role
We act as intermediary between you and suppliers (hotels, transport, guides, etc.). We are not responsible for the acts or omissions of these suppliers.
7.2 Limitation of Liability
Our liability is limited to:
- The total amount paid for your trip
- We are not liable for indirect, consequential, or punitive damages
- This includes lost profits, business interruption, or emotional distress
7.3 Supplier Liability
Each supplier operates under their own terms and conditions. Claims should be made directly with the supplier when possible.
7.4 Activity Risks
Adventure activities carry inherent risks. Participation is voluntary and at your own risk.
8. Force Majeure
We are not responsible for failure to perform due to circumstances beyond our control, including:
- Natural disasters, extreme weather
- War, terrorism, political instability
- Government actions, strikes, labor disputes
- Pandemic or epidemic diseases
- Supplier bankruptcy or cessation of operations
Force majeure events may result in trip cancellation, modification, or delay without compensation beyond refund of recoverable costs.
9. Behavior and Conduct
9.1 Acceptable Behavior
Travelers must:
- Respect local customs and laws
- Follow guide instructions and safety guidelines
- Treat fellow travelers and staff with respect
- Comply with accommodation and transport rules
9.2 Unacceptable Behavior
We reserve the right to remove travelers who:
- Endanger themselves or others
- Engage in illegal activities
- Disrupt the group experience
- Fail to follow reasonable instructions
Removal results in immediate termination without refund.
